Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Loremaster platform and related applications, websites, and services (collectively, the "Service"), provided by Valfar and Sons, Inc., a Delaware corporation ("Valfar and Sons," "we," "us," or "our").
By creating an account, purchasing a subscription, or otherwise accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
For purposes of these Terms:
- "Account" means the user account you create to access the Service.
- "AI Output" means any output, recommendation, response, summary, transcription, or generated content produced by the Service using machine learning or artificial intelligence.
- "Subscription" means a paid plan that provides access to the Service or certain features.
- "User Content" means any content you upload, submit, transmit, store, or otherwise provide through the Service, including but not limited to campaign information, transcripts, audio recordings, notes, and other materials.
2. Eligibility (18+ Requirement)
You must be at least 18 years old to create an account or use the Service.
By using the Service, you represent and warrant that:
- You are 18 years of age or older, and
- You have the legal capacity to enter into these Terms.
3. Accounts and Registration
3.1 Account Creation
To use the Service, you may be required to create an account using:
- An email address and password, or
- Third-party sign-in methods such as Google or Discord OAuth.
You agree to provide accurate and complete information and to keep your Account information current.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account.
If you believe your Account has been compromised, you must notify us immediately at support@valfarandsons.com.
4. Service Changes
You acknowledge that:
- Features may change, degrade, or be removed at any time,
- The Service may experience interruptions or unexpected behavior, and
- You may encounter errors, unexpected results, or incomplete functionality.
We may update, modify, or discontinue the Service (in whole or in part) at any time.
5. User Content
5.1 Ownership
You retain ownership of your User Content.
5.2 License to Operate the Service
To provide the Service, you grant Valfar and Sons a worldwide, non-exclusive, royalty-free, sublicensable (to our service providers), and transferable license to host, store, cache, reproduce, process, modify (for technical formatting only), analyze, and display your User Content solely to provide, maintain, secure, and improve the Service, including to:
- Store audio recordings and related files you submit,
- Generate transcripts, summaries, notes, and other AI Outputs, and
- Improve product quality, reliability, and abuse prevention.
This license ends when your User Content is deleted from the Service, except to the extent we are required to retain it to comply with legal obligations, enforce these Terms, resolve disputes, or maintain backup and security integrity for a limited period.
5.3 Your Content Representations
You represent and warrant that:
- You own or have all necessary rights to your User Content, and
- Your User Content does not violate applicable law or third-party rights.
5.4 Consent / Permissions Responsibility (Recording & Uploading)
You are solely responsible for ensuring you have all necessary rights, permissions, and lawful consent to:
- Record audio,
- Upload audio recordings,
- Upload transcripts,
- Upload notes or other content relating to other individuals, and
- Use the Service in connection with any third-party content or personal information.
You must maintain and retain your own records of consent and permissions. We do not verify that you have obtained valid consent, and we are not responsible for any failure to do so.
5.5 Content Restrictions
You agree not to upload User Content that:
- Violates any law or regulation,
- Infringes intellectual property rights,
- Violates privacy or publicity rights,
- Includes confidential information you do not have the right to disclose, or
- Contains malware or other harmful code.
6. Acceptable Use and Abuse Policy
You may use the Service only for lawful purposes and in compliance with these Terms.
6.1 Prohibited Conduct
You agree not to, and not to attempt to, do any of the following:
A. Harmful or illegal activity
- Use the Service for unlawful, harmful, abusive, harassing, threatening, hateful, or violent activity.
- Promote self-harm, suicide, or instructions to cause physical harm.
- Create, share, request, or facilitate content involving sexual exploitation or abuse of minors.
B. Misuse of the Service
- Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying components of the Service except to the extent prohibited by law.
- Circumvent rate limits, access controls, or other safeguards.
- Use automated means to scrape, extract, or harvest data from the Service except as expressly permitted by us in writing.
C. Security and interference
- Interfere with or disrupt the integrity or performance of the Service.
- Introduce malware, spyware, or other malicious code.
- Attempt unauthorized access to Accounts, systems, or networks.
D. Misrepresentation
- Impersonate any person or entity or misrepresent your affiliation.
- Use the Service to generate deceptive or misleading content intended to defraud others.
6.2 Enforcement
We may investigate suspected violations and may take action at our discretion, including removing content, restricting functionality, suspending or terminating Accounts, and/or reporting conduct to law enforcement where appropriate.
7. AI Output Disclaimer (No Guarantee)
The Service may generate AI Outputs using machine learning or artificial intelligence.
You acknowledge and agree that:
- AI Outputs may be inaccurate, incomplete, misleading, or incorrect,
- AI Outputs are provided for informational purposes only, and
- You are responsible for verifying any AI Outputs before relying on them.
We do not guarantee that AI Outputs will be correct, complete, or fit for any particular purpose, including gameplay accuracy, rules interpretation, narrative consistency, or campaign outcomes.
8. Subscriptions, Fees, and Billing
8.1 Paid Access
Certain features of the Service require payment. You agree to pay all applicable fees and taxes associated with your use of the Service.
8.2 Automatic Renewal
Unless you cancel, your Subscription will automatically renew at the end of each billing period, and you authorize us (and our third-party payment processor) to charge your selected payment method for the renewal.
8.3 Cancellation
You may cancel your Subscription at any time through the account settings (if available) or by contacting support at support@valfarandsons.com.
Cancellation will take effect at the end of the current billing period unless otherwise required by law.
8.4 Billing Failures
If your payment method fails or your account becomes past due, we may suspend or limit access to paid features until payment is successfully processed.
8.5 Changes to Fees
We may change Subscription fees or introduce new charges with advance notice where required by law. Continued use of the Service after the changes take effect constitutes your agreement to pay the updated fees.
8.6 Refunds
Refund requests (if any) are handled on a case-by-case basis through support. To request billing support, contact support@valfarandsons.com.
8.7 Usage Limits / Caps
We may impose usage limits, throttling, or hard caps (for example, based on minutes, messages, storage, or processing usage). We may enforce these limits to maintain stability, prevent abuse, or ensure fair use across users.
9. Third-Party Services and Integrations
The Service may integrate with or allow access through third-party services (for example, Google or Discord login) ("Third-Party Services").
You acknowledge and agree that:
- Third-Party Services are governed by their own terms and privacy policies,
- We do not control Third-Party Services and are not responsible for their availability, security, or functionality, and
- Changes in Third-Party Services may impact your ability to access or use the Service.
10. Intellectual Property
10.1 Our Intellectual Property
The Service (including software, designs, interfaces, and branding) is owned by Valfar and Sons or its licensors and is protected by intellectual property laws.
Except for the limited right to use the Service under these Terms, no rights are granted to you.
10.2 Feedback
If you provide feedback, ideas, or suggestions about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free right to use that Feedback without restriction or compensation.
11. Account Suspension and Termination
11.1 By You
You may stop using the Service at any time. You may request account closure by contacting support@valfarandsons.com.
11.2 By Us
We may suspend or terminate your Account and/or access to the Service immediately, without notice, if we reasonably believe:
- You violated these Terms,
- Your use presents a security, legal, or operational risk, or
- Continued access may harm us, other users, or third parties.
We may also suspend or terminate access as part of discontinuing the Service or any feature.
11.3 Effect of Termination
Upon termination, your right to access the Service will stop. Some provisions of these Terms will survive termination, including ownership, disclaimers, limitations of liability, and dispute provisions.
12. Copyright Complaints (DMCA Policy)
We respect intellectual property rights and expect users to do the same.
If you believe that content on the Service infringes a copyright, you may send a notice to us at:

Subject line: DMCA Notice / Copyright Claim
Your notice should include:
- Identification of the copyrighted work claimed to have been infringed,
- Identification of the allegedly infringing material and information reasonably sufficient to locate it,
- Your name, address, telephone number, and email address,
- A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law, and
- A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on their behalf.
We may remove or disable access to content alleged to be infringing and may terminate repeat infringers where appropriate.
13. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge and agree that we may process personal information as described in that policy.
14. Disclaimer; No Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VALFAR AND SONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE,
- ANY RESULTS OR OUTPUTS WILL BE ACCURATE OR RELIABLE,
- DEFECTS WILL BE CORRECTED, OR
- USER CONTENT WILL NOT BE LOST.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
IN NO EVENT WILL VALFAR AND SONS, ITS AFFILIATES, OR ITS OFFICERS, EMPLOYEES, DIRECTORS, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO VALFAR AND SONS FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
- $100 USD.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless Valfar and Sons and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service,
- Your User Content (including audio recordings and transcripts),
- Your failure to obtain valid consent or permissions, or
- Your violation of these Terms or any applicable law.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
You agree that any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.
18. General Terms
18.1 Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will remain in effect.
18.2 No Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
18.3 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms (for example, in connection with a merger, acquisition, restructuring, or sale of assets) without restriction.
18.4 Entire Agreement
These Terms (together with any policies referenced herein) constitute the entire agreement between you and Valfar and Sons regarding the Service and supersede any prior agreements.
18.5 Force Majeure
We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental action, internet service disruptions, or failures of third-party providers.
18.6 Notices
We may provide notices to you via email, through the Service, or by other reasonable means. You are responsible for keeping your contact information current.
